WASHINGTON, Sept. 13, 2017 /PRNewswire/ -- The Corporate Whistleblower Center says, "We are urging a pharmaceutical company manager or sales representative to call us anytime at 800-714-0303 if they have proof their employer is overbilling Medicare or Medicaid. "If you are a pharmaceutical or medical device company and you can prove your competition is cheating Medicare or Medicaid out of millions-please call us about rewards and potentially a huge competitive edge over your competition. Whistleblowers exactly like this will receive approximately $38.7 million as their share of a recent federal False Claim Act settlement. In August 2017, the Department of Justice announced a major settlement involving a US based pharmaceutical company had agreed to pay $465 million to resolve claims that they violated the False Claims Act by knowingly misclassifying its pharmaceutical product as a generic drug to avoid paying rebates owed primarily to Medicaid.
The settlement resolves the government's allegations that the drug company was erroneously reporting their product as a generic drug to Medicaid despite the absence of any therapeutically equivalent drugs, and the company received massive price increases in the private market while avoiding its corresponding rebate obligations to Medicaid. Between 2010 and 2016, the pharmaceutical company increased the price of their product by approximately 400 percent yet paid only a fixed 13 percent rebate to Medicaid during the same period. The government further alleged that although the drug company was well-aware that its drug was not a generic, it nevertheless claimed generic status for its product in the Medicaid program to avoid paying a higher rebate.
Simple rules for a whistleblower from the Corporate Whistleblower Center: Do not go to the government first if you are a major whistleblower. Do not go to the news media with your whistleblower information. Public revelation of a whistleblower's information could destroy any prospect for a reward. Do not try to force a company or individual to come clean on Medicare overbilling or Come to us first, tell us what type of information you have, and if we think it's sufficient, we will help find the right law firms to assist in advancing your information.
