Court Filing Update: Gizmo Medical Founder and Former Life Spine CEO Vindicated After Court Dismisses Majority of Life Spine’s Claims and Company Withdraws Remaining Allegations

CHICAGO–(BUSINESS WIRE)–Gizmo Medical announces that Life Spine has voluntarily dismissed its lawsuit against founder and former CEO Michael Butler, following a court ruling that dismissed the majority of the company’s claims before discovery even commenced.

The now-dismissed Life Spine lawsuit was commenced several months after Mr. Butler filed a lawsuit in the Cook County Chancery Court — Butler v. St. Cloud Capital Partners III, SBIC, LP, et al., Case No. 2025-CH-03730 — against Life Spine’s lenders and lender-appointed directors, alleging breaches of fiduciary duty and other claims based on the defendants’ misconduct. Mr. Butler’s earlier action remains pending.

Life Spine filed its lawsuit in June 2025, and its efforts to obtain a temporary restraining order were swiftly rejected by the court. Mr. Butler promptly filed a motion to dismiss Life Spine’s lawsuit, pointing out numerous defects in Life Spine’s allegations, which led to the court’s dismissal order on October 20, 2025.

Days after the court’s order, Life Spine filed a motion for voluntary dismissal of its claims, which the court granted on November 3, 2025.
